These Terms & Conditions (“Terms”) govern your use of www.chemistryrescue.com (the “Website”), our online learning platform, and all educational products, digital materials, memberships, and services provided by ECT Learning LLC, doing business as Chemistry Rescue (“Chemistry Rescue,” “Company,” “we,” “our,” or “us”). By accessing or using the Website or Services, you agree to be bound by these Terms. If you do not agree, discontinue use immediately.

 

1. Eligibility and Use of Services

The Services are intended for users at least 16 years old. Individuals under 18 (“Minor Users”) may use the Services only when a parent or legal guardian purchases the Services, creates the account, and directly supervises the Minor User. The parent becomes the legal contracting party and assumes full responsibility for the Minor User’s actions, submissions, and compliance with these Terms. Minor Users may not independently create accounts, submit personal information, or make purchases. Chemistry Rescue does not knowingly collect personal data from children under 13. We may revoke access to any user who violates these Terms or disrupts the learning environment.

 

2. Accounts and Security

Some Services require account creation. You agree to provide accurate information and to safeguard your login credentials. You are responsible for all activity under your account. Chemistry Rescue is not liable for unauthorized access resulting from your failure to secure your credentials or device.

 

3. Payments, Subscriptions, Billing & Right to Refuse Orders

Some Services require payment, including one-time purchases and recurring subscriptions. By enrolling in a subscription, you authorize recurring automatic charges until cancellation. Cancellations apply prospectively and do not entitle you to refunds for prior charges unless required by law. All sales of digital products, courses, coaching, and subscriptions are final unless explicitly stated otherwise at purchase.

Chemistry Rescue reserves the right to refuse, cancel, or limit any order, purchase, enrollment, or subscription at our sole discretion, including cases involving pricing errors, suspected fraud, misuse of the Services, breach of these Terms, or any other reason. If an order is canceled after payment has been processed, we will issue a refund unless a violation of these Terms occurred.

 

4. Course Access and Expiration

Access to courses and materials is provided only for the duration stated at purchase. Chemistry Rescue may update, modify, replace, or remove course materials at any time. We do not guarantee ongoing or indefinite access to any specific course, resource, or feature.

 

5. Intellectual Property

All educational materials—including videos, worksheets, PDFs, diagrams, guides, digital downloads, written explanations, and Q&A content—are the exclusive property of ECT Learning LLC. You receive a limited, non-transferable license for personal educational use only. You may not copy, record, distribute, modify, upload, reverse engineer, resell, or repurpose content. You may not share your account or use the Services to produce competing content or assist academic dishonesty. All rights not granted are reserved.

 

6. Integrated Code of Conduct

Users must behave respectfully and professionally when using the Website or Services. Harassment, threats, discrimination, inappropriate content, academic dishonesty, sharing exam answers, spam, disruptive behavior, hacking attempts, or misuse of the learning platform are prohibited. Violations may result in suspension or termination without refund.

 

7. User-Generated Content

If you submit comments, posts, or other content, you are solely responsible for your submissions. By submitting content, you grant Chemistry Rescue a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content for educational or community purposes. Chemistry Rescue may monitor, edit, restrict, or remove submissions at its discretion.

 

8. Educational and Accuracy Disclaimers 

The Services are provided for general educational purposes only. Chemistry Rescue does not guarantee academic performance, grades, exam scores, or admission outcomes. Chemistry concepts vary across instructors and institutions, and our content may not align with your specific course or textbook. While Chemistry Rescue strives to provide clear, accurate, and up-to-date information, errors, inaccuracies, omissions, or outdated content may occur, and some material may not reflect the most current developments in the field. All content is provided “as is” without warranties of accuracy, completeness, or reliability.

Individual results vary. Performance depends on personal effort, study habits, engagement, consistency, prior knowledge, and adherence to instructions. Chemistry Rescue cannot guarantee any specific academic outcome.

 

9. Illegal or Unauthorized Use

You may not use the Website or Services for any illegal or unauthorized purpose. Any illegal or unauthorized use constitutes a breach of these Terms and may result in termination without refund.

Outages may occur due to maintenance, system updates, hosting failures, cyber incidents, or events beyond our control. Chemistry Rescue is not liable for losses, delays, or damages resulting from downtime or inability to access the Services.

 

11. Errors, Inaccuracies & Corrections

The Website and Services may contain typographical errors, inaccuracies, omissions, outdated information, or pricing mistakes. Chemistry Rescue reserves the right to correct errors, inaccuracies, or omissions and to update information at any time without prior notice, including after an order has been submitted. Chemistry Rescue is not liable for damages or losses arising from such errors or corrections.

 

12. Limitation of Liability

To the fullest extent permitted by law, Chemistry Rescue is not liable for direct, indirect, incidental, consequential, punitive, or special damages, including academic outcomes, lost data, lost profits, or platform downtime. If liability is ever established, it is limited to the amount paid for the Service involved.

 

13. Indemnification

You agree to indemnify and hold harmless Chemistry Rescue and its owners, employees, contractors, and affiliates from any claims, damages, losses, or expenses arising from your misuse of the Services, breach of these Terms, violation of academic policies, or infringement of intellectual property rights.

 

14. Third-Party Services

The Website may link to or integrate with third-party tools such as payment processors, analytics tools, and video platforms. Chemistry Rescue is not responsible for the actions, content, performance, or privacy practices of third-party services.

 

15. Modifications to Services or Terms

16. Termination 

Chemistry Rescue may suspend, modify, or terminate your access to the Website or Services at any time, for any reason or no reason, with or without notice. We may also terminate your access immediately for breach of these Terms, violation of the Code of Conduct, academic misconduct, or misuse of the Services. Upon termination, all licenses immediately cease and access is revoked. No refunds will be issued unless required by law.

 

17. Governing Law and Binding Arbitration

These Terms are governed by the laws of the State of Florida. Any dispute must first undergo good-faith negotiation. If unresolved within thirty (30) days, the dispute shall be resolved exclusively by final and binding arbitration in Florida unless both parties agree upon a different location. Users waive the right to bring claims in court, including small claims court, and waive jury trial and class action rights.

 

18. Severability

If any part of these Terms is found invalid or unenforceable, that part will be modified only as necessary to make it enforceable. All remaining provisions remain fully effective.

 

19. Entire Agreement

These Terms, along with the Privacy Policy and any posted notices, constitute the entire agreement between you and Chemistry Rescue.
